What you be better, (because the TOS is more about the usage of the product rather than the content) is when you undock, a huge, screen wide pop-up with
“By undocking your ship, you are consenting to PVP. Do you wish to undock?”
If you click yes, then there is another pop-up
“Are you absolutely sure you want to undock, you may loose your ship due to PVP?”
This time if you consent you have to type out “I consent to PVP.”
Now this may seem like a lot, but the second step would go away on the 501st typing. This way it is ingrained in the persons mind, and they have been conditioned to accept that the game is PVP, no matter where they are at.
Perhaps, winning could also mean experiencing the thrill, not necessarily the W/L ratio…

The laws are in place alright, only they’re there to protect some people and not others. Just like the cops, they’re there to protect some people and not others.
The topic is consent. It’s consent, not experience. One made the argument that in real life, you consent to being murdered by leaving your house- or being born… that isn’t the case because the laws prevent that. You can be murdered, but you can’t be considered to have consented just by leaving your house or by being born.
This is about consent.

Back to consent: Technically by leaving home, you accept that a mugger will go to jail when caught. You hope nobody will mug you, and you definitely don’t want anyone to mug you (because then it wouldn’t be illegal, like a PvP duel). So any player’s consent is not referring to the deeds but to the rules which apply to the deeds.
And because the consequences of this little difference are kind of complicated, the Golden Rules are a guidance.
