Do pirate forward operating bases in high sec spawn at downtime? Or is the spawn rate some random interval assessed during the day.

No idea, and difficult to find out, because the agency shows wrong information. Already dead FOBs are shown until next downtime, and some FOBs are only shown if you are in system (or somewhat randomly).

Given the issues with the Agency, is there another approach to determining if the FOB is in a given system then? Or is this only accomplished via probes/dscan?

If you are in the system, the agency shows it. At least for the FOBs I killed this was the case. If it was already killed you can check on zkill or probe it down.
