How could it be that the reason for acquittal on basis of passing sensitive information was that the accused “didn’t have access?” He was a commissioned officer, was he not?
However, even more strange is that by Kim’s own admission all evidence of their meetings was lost or destroyed. Where’s the proof that they happened at all? Phrases like “evidence was undeniable” are not actual evidence. Kim has also conveniently left out all reference to defenses offered by the accused, if he was even allowed the opportunity to present them.
I’m sure you’re correct regarding the application of fraternization rules in the UCMJ to FedNav personnel. What’s less clear is the applicability of such military justice to capsuleer commanded crews in the first place. Certainly Kim is free to incorporate by reference any codes of conduct she pleases into her employment contracts. I have personally never found that kind of thing useful for keeping my crews motivated and at top performance.
Again, this all seems more like a thin pantomime of legalism to satisfy a crazed whim than actual justice to me.
As a member of a capsuleer militia, Kim insists she is, in fact, a legitimate officer in the Caldari State’s military apparatus, and not simply a loyalist mercenary. As such, she engages in what is probably best called an extremely fictionalized pretext of role-playing, and going through the motions. I have absolutely no doubt that she’s applying one of the Caldari State’s military services’ legal procedings in this (probably the Caldari Navy, but given the kangaroo court the Caldari Customs Service paraded around last year, possibly theirs).
Now, whether or not this fellow had access to sensitive information depends on how compartmentalized things are. If they’re properly compartmentalized, a baseliner crewmember, even an officer of the crew, on a merc’s ship won’t have access to anything truly sensitive…
… except things like the layout of the facilities, where the armories are, access points, etc. And that, we know he had access to, because he used that access to clandestine ways in and out of the station to smuggle his paramour in and out. So on that one… I got nothing. It seems like of all of it, that’d be one of those things where the slam-dunk would definitely be in play, but apparently not? She just… appeared? and then walked out through solid bulkhead? I dunno.
Well, I actually don’t dispute the legitimacy of Militia service as a role within empire affiliated armed services for capsuleers. Each militia is officially chartered within their respective nation, militia pilots are granted rank for their service, and rewarded for completing tactical objectives and missions. We are also punished for conduct violations via standings reductions and demotions. Obviously some pilots take that affiliation more seriously than others. However, rules that apply to capsuleers are by design entirely different than rules applied to baseliners. I don’t think crews in service to militia flagged ships can automatically be said to be subject to military law, especially since capsuleers are able to join or leave militia service at will.
So I wouldn’t say what she’s doing is pure fiction, but I take issue with the level of constraint she claims to be under from these “laws.” As I said, capsuleers are free to impose whatever codes of conduct on their crews that they please. If she wants to impose Caldari Navy military discipline, fine. But at the end of the day, she should acknowledge that doing so was her choice. And by that token, what this unfortunate officer did was commit a crime against Diana Kim. The State is only involved by proxy.
And that is a typical example of gallentean propaganda, lies and slanders. It’s obvious I don’t have any “unstable” behavior, unlike our… “opponents” love to proclaim.

Romantic relations or sexual relations? If it was romantic, were both in love, or just one of them? Those fact will impact greatly on the extend of the security threat and hence the repercussions.

He wasn’t married so sexual relations were not implied, nor evidences about them were presented. Charges in that could be presented only if indecent behavior could be proven, but there indeed was lack of evidences, as all camera footages were either damaged or covered.

The essential issue in this case if not if it is a serious offence or not, but if it is a serious military offence. Civil offencces can be handled by the appropriate courts, but as an officer of the military you should concern yourself only with military offences. You are a military officer after all and meddling in non-military matters should be beneath your notice and would only serve to enlarge any stain on your honor.
For charges 1. and 2. you should present evidence if there is any. Charge 3. you should let the military court handle, charge 4 should be handled by any civil court if appropriate.
Any more action would only serve to raise suspicion in that you are personally involved in these matters somehow.

For 2, the evidences are several hours of camera footages, testimonies of witnesses, registering two people passing the automated security check under ID of Mr. Raikkanen. The malicious intent was assumed from the attempts to hide from camera view, disrupting the recordings or occluding cameras during meetings. All these together with whole proceedings of the tribunal can be sent by NeoCom mail on request due to the volume of the material.
They both were already handled by the military court.
