Obtaining a refund (under EU commerce laws)

I have asked a refound, having made a purchase of 6 months just few hours ago. I wish to cancel it, under article 50 of the TEU ( Under EU rules, a trader must repair, replace, reduce the price or give you a refund if goods you bought turn out to be faulty or do not look or work as advertised.

If you bought a product or a service online or outside of a shop (by telephone, mail order, from a door-to-door salesperson), you also have the right to cancel and return your order within 14 days, for any reason and without a justification.)

Anyone has ever asked/obtained it?

I got ganked in high sec by NPCs, in the middle of a relic site hacking. The sector was not flagged as invaded. I had my beloved T1 explo frigate with 7 killmarks on it. I never had such an epic rage quit.

Kills by NPC aren’t loaded on kill mail, unless the player does. So it’s not me being a liar, it’s you being a douchebag.

Working as intended, NPCs have always been able to feck you up, regardless of invasion flagging.

You did by trying to use the rule as you stated in your first post.

game is not faulty, you just suck and didn’t use D-scan. There are other NPC’s that can destroy you.

this one doesn’t work either. I’ll assume you purchased online time before, this rule wouldn’t take effect, plus you didn’t purchase the time by telephone, mail order or from a d2d person.

There are exemptions to this rule, namely online digital content.

You have the right to cancel and return your order within 14 days , for any reason and without a justification. This “cooling off” period expires 14 days after the day you received your goods (or concluded a contract for services).

However, the 14-day cooling off period does not apply to all purchases . Some of the exemptions are:

  • plane and train tickets, as well as concert tickets, hotel bookings, car rental reservations and catering services for specific dates
  • goods and drinks delivered to you by regular delivery – for example grocery shopping delivered by your local supermarket
  • goods made to order or clearly personalised – such as a tailor-made suit
  • sealed audio, video or computer software, such as DVDs, which you have opened (unsealed) upon receipt
  • online digital content, if you have already started downloading or streaming it and you agreed that you would lose your right of withdrawal by starting the performance
  • goods bought from a private individual rather than a company
  • urgent repairs and maintenance contracts – if you call a plumber to repair a leaking shower, you can’t cancel the work once you have agreed on the price of the service

I didn’t download anything after the purchase. I have bought playing time in Omega, which doesn’t need any download.

Namely EvE is FREE. It’s the Omega status you buy, and you don’t download it.

you don’t buy “alpha” you buy omega game time. still, you purchased online digital content. It does not count towards you getting a refund.
