it was implied that eve was the only exception. But thanks for making my point.

I will stop you there.

which courts and what rulings?

=== here is a quote from a paper on the subject.

The ability to sell, and prosecute persons for the theft of virtual property, remains in South Korea even if the ownership of the property is “either ambiguous or located in the virtual environment creator.” However, a consumer group has “filed a complaint against NCsoft with South Korea’s antitrust regulatory agency to establish virtual rights.”Fairfield suggests that this is an attempt to prevent the MMO game creators from abusing their monopoly position.

===

Because of the ownership now of EVE, they are governed by South Korea’s regulatory control.
and again

===
China’s recognition of virtual property rights was crystallised in Li Hongchen v. Beijing Arctic Ice Technology Development Co. 34 An individual who played in the virtual world of Hongyue (Red Moon) had his account hacked and all of his items stolen. The player sought help from both the game creators and police but was refused assistance. 35 Consequently, a lawsuit was filed against the game designer and the Beijing Second Intermediate Court ordered the restoration of property to the player. The decision was affirmed by the Court of Appeal. 36 Adrian wrote that this case stood for the proposition that a “player has a property right in virtual objects that could be recognized in a real-world court.”

===

And

===

From a practical perspective, one expects that when this issue arrives before a Canadian court, virtual property will be treated like any other asset and the court will apply existing laws that are not virtual property specific.

===

I am in Canada. No contract even an EULA can take away fundamental rights. EULA is a contract with no teeth.

I am under no obligation to continue providing you with free legal counsel.

Feel free to hire an attorney.

epic fail.

Put your money where your mouth is. Don’t let me stop you.

I do believe if eve was legally tested it might come to pass that the insurance system would be beefed up a lot and everyone would have basic insurance that would restore 90% of all losses including theft.

Good thing there is an on going database of all game losses thanks to zkillboard.

Get the fudge out of here. You realize that rigidly applying property laws to Eve would kill it, right? In fact, it would kill entire subgenres of games (such as battle royale shooters). Look, if you were to wager real life money on a game in a casino, you wouldn’t have legal recourse if they took your money. You willingly played the game, and you willingly wagered your property. Well, same thing with Eve. You are knowingly playing a PvP centric game with a full loot death mechanic, mechanics that allow for all sorts of scumbaggery, and a EULA that allows for all of it. IIRC, the only thing that is explicitly forbidden is trying to get a target to buy plex as part of the scam (you are free, however, to scam him out of plex that you already bought).

If you do not like these mechanics or accept these terms, you should go play something else. And if you do play, it is highly advisable that you manage your risk (beginning with don’t fly what you can’t afford to lose).

Now, I do think you can make an argument that it is unethical for the devs/the house to make design decisions that psychologically manipulate patrons/customers into making bad decisions so as to maximize profits. However, CCP is, for the most part, not doing that (some of their plex ads annoy me, but that’s a whole another can of worms). And they are certainly not doing it by allowing you to buy plex (which is analogous to exchanging cash for poker chips in my little analogy).

Ugh… why am I having this conversation. You have a really weird way of looking at things, and I’m not sure that any amount of debate is going to help us see eye to eye on this. So, I’m going to do something a little less pointless… like peeling avocados or arguing with a flat-earther.

Actually no. CCP has that database. zkillboard isn’t a record of all losses at all. Not by a long stretch. It’s only a record of losses people allow zkill to obtain + all losses from wars.

Are you a qualified Texas quacamole lawyer?

If not, I’m not so sure you should be making these types of assessments.

Some one likes ED too much methinks.

um… erectile dysfunction?

Oh, Elite Dangerous. Well, I’m hitting reply anyway. :stuck_out_tongue:

Titans still have too much HP.

Again you guys make my point, gambling is illegal in both South Korea and in Iceland. You have to pick your poison. Can’t have your cake and eat it too.

Plex should be for cosmetics only.

Sorry Im late. Was this person hacked and CCP refused to help?

Once again, courts have already addressed the issue. Internet games are considered “games of skill” and not “games of chance” - the latter is highly regulated, the former is not. As this is a roleplaying game, the dungeon masters (CCP) have wide latitude to do whatever they want. You are aware of this, it’s in the EULA, it’s established by court precedent, and I’ve told you. You have been duly informed of the facts.

He seems to think that CCP uses the full loot death mechanic to incentivize microtransactions. Thus, CCP should get rid of plex.

Anyway, I’m not so sure he’s worth engaging with because he has extremely unrealistic expectations if he thinks CCP is going to restore everything that everyone has ever lost. In case he does read this, however:

  • Don’t fly what you can’t afford to lose
  • You can’t microtransaction your way to success in Eve
  • You are entitled to nothing -not your payouts, your loot, your loot drops, nor your win states. The only things that belong to you are what you are capable of claiming and holding on to -and that will be determined by your skill, wits, and determination.
