Poco is a structure so id assume it does make you eligible
Yes, a POCO will make you war eligible, but it cannot be used as a War HQ (meaning you still can’t declare war on other entities).

Why would this be a loophole?
How else are you going to be able to kill a POCO if it weren’t possible to legally attack one in HS space?
Or would you suggest that players should be able to freely attack your POCO in HS without a war?

Pocos and POS allow for war dec assistance but make it very hard to find that enabling structure. This could be seen as a loophole.

You do not need a War HQ for an assist as far as I know.
I cannot [yet] find an EVE article that explicitly states what structures can be used as War HQs, but I did find this note:
- Note: Hull Reinforcement Duration for War Headquarters structures is 24 hours instead of the 4.5 days for structures not designated as a War HQ.
POCOs do not have a Hull Reinforcement phase, so I think this excludes them.

The following player owned structures will allow other corporations to declare war on their owners:
All Upwell Structures (including Upwell FLEX structures)
Starbase Control Towers
Player-owned Customs Offices and their Gantries
Sovereignty Structures of any kind (such as Infrastructure Hubs and Territorial Control Units)
